On February 14, 2020, Judge Kerri Johnson, of
the Natrona County District Court entered an order rejecting the State's
request to file another motion to dismiss. The Wyoming Supreme Court had previously granted John's petition for certiorari
and reversed and remanded for an evidentiary hearing. A second motion by the State would have delayed the resolution of the
merits of John's pending verified petition for postconviction relief that has been on file for over a year.
The State has been directed to file responses to John's requested discovery that were sent to the Attorney General in
November of 2019 by Monday, March 16, 2020. John's discovery has requested that the State either admit or deny the
merits of the forensic reconstructions that the window was not shot out by John as claimed at trial, but was broken by
Mr. Baldwin who then attacked John when the .45 was discharged.
Witness lists and exhibit lists are to be provided by
June 15, 2020. Discovery is to be completed and any other potentially dispositive motions (such as for summary judgement by John)
are to be filed no later than July 10, 2020. There will be a final pre-trial hearing on August 6, 2020. The evidentiary hearing,
if required, will be on August 27, 2020 beginning at 9:30 am.
It has been a long road for John and we hope that justice will
prevail in his case.
